1.2 Service Definition

NowCam (hereinafter "Service") is a mobile application service that allows users to capture photos or import existing photos from their device album, automatically overlay current date, time, and day information as timestamps on images, and save them.

1.3 Service Features

• Timestamp Functionality: Automatically overlay current time information on photos
• Multi-language Support: Support for 3 languages (Korean, English, Japanese)
• Album Integration: Import existing photos from device album

1.4 Terms Effectiveness and Consent

• By using the app, users are deemed to have agreed to these terms and the privacy policy
• When terms are changed, notification will be provided through app updates, and continued use is deemed as consent to the changed terms

2. User Obligations

2.1 Account Management

• Users are responsible for the security of their device and app data
• Users are responsible for managing and storing captured photos

2.2 Legal Use

• The service must be used only for legal purposes
• Cannot be used for illegal or inappropriate purposes
• Cannot capture or use content that infringes on others' intellectual property rights
• Cannot be used to violate others' privacy or defame others

2.3 Data Management

• User Responsibility: All captured photos are stored locally on user devices, and users are entirely responsible for data storage
• Storage Management: Users are responsible for increased storage capacity due to captured photos
• Data Loss: Developers are not responsible for data loss due to device errors, app errors, user mistakes, etc.
• Accuracy Responsibility: Timestamp accuracy depends on device system time, and users must verify the accuracy of device time settings

2.4 Minor Usage

• Users under 14 years of age must obtain consent from legal guardians (parents) to use the service
• When minors use the service, they must comply with relevant laws and regulations

3. Service Provision and Usage

3.1 Service Usage

• The service is provided free of charge and operated through advertising
• Banner ads are displayed at the bottom of all screens including main camera screens
• Users can discontinue service usage by deleting the app at any time

3.2 Service Limitations

• The service is intended for personal use and may be restricted for commercial purposes
• Features requiring network connection (Firebase services, ad display) may be limited depending on internet environment
• Ad display control through Firebase Remote Config may change according to server settings

3.3 Technical Support

• Technical issues with the app can be inquired through the in-app 'Settings > Contact Us' feature
• While we do our best to support compatibility issues due to OS updates or device changes, we cannot guarantee perfect compatibility in all situations

4. Intellectual Property Rights

4.1 Service Intellectual Property Rights

• All intellectual property rights including source code, design, trademarks of the NowCam app belong to the developer
• Users can only use the app for service usage purposes and cannot reverse engineer, copy, or distribute it

4.2 User Content

• Ownership of photos captured by users using the app belongs to the users
• User content is stored only on user devices, and developers do not access or use it
• Users are entirely responsible for the use of photos with timestamps added

4.3 Open Source Libraries

• This app uses various open source libraries and complies with each library's license
• Main libraries used: Flutter, Riverpod, go_router, Firebase, Google Mobile Ads, etc.

5. Disclaimers and Liability Limitations

5.1 Service Provision Responsibility

• The service is provided "as is," and developers do not guarantee completeness, accuracy, or stability of the service
• Developers are not responsible for data loss due to app errors, device problems, user mistakes, etc.
• Timestamp accuracy depends on device system time, and developers are not responsible for system time errors

5.2 Damage Compensation Limitations

• Developer liability for direct or indirect damages arising from service usage is limited to the extent permitted by relevant laws
• Developers are not responsible for users' business losses, data loss, opportunity losses, etc.

5.3 Third-Party Services

• Issues arising from the use of third-party services such as Firebase, Google AdMob follow the terms of the respective service providers
• Developers are not responsible for impacts due to policy changes or service discontinuation of third-party services

6. Advertising and Monetization

6.1 Ad Display

• The service displays ads through Google AdMob to cover operating costs
• Ads are always displayed at the bottom of all major pages within the app
• Users can control ad personalization through device settings

6.2 Ad Control

• Ad display can be controlled in real-time from the server through Firebase Remote Config
• Ad display policies may change according to developer's judgment

7. Terms Changes and Service Termination

7.1 Terms Changes

• These terms may be changed due to changes in relevant laws or service improvements
• When terms are changed, notification will be provided through app updates, and important changes will be announced separately
• If users do not agree to changed terms, they must discontinue service usage

7.2 Service Termination

• Developers may terminate the service due to unavoidable circumstances, and in such cases, notice will be provided at least 30 days in advance
• Upon service termination, user data remains locally but app functionality becomes unavailable
• Before service termination, users can move captured photos to device album for storage

7.3 Data Portability

• Users can move captured photos to device album or backup to other storage at any time
• App setting data stored locally is deleted when the app is deleted

8. Miscellaneous

8.1 Governing Law and Jurisdiction

• These terms are interpreted according to the laws of the Republic of Korea, and disputes related to service usage are subject to the exclusive jurisdiction of the Busan District Court

8.2 Terms Effectiveness

• Even if some provisions of these terms are determined to be invalid, it does not affect the effectiveness of the remaining provisions
